Subject: Care of Mrs Evelyn Lovelock

Many Thanks for your letter dated 3rd January (no Reference), responding to my SUEM1 and SUEM2 , now on the web site www.NHSCare.info/EvelynLovelock above. One copy of SUEM2 was addressed to the Appeals Convener, Wokingham PCT.

In your letter you suggest, "...the best way to proceed is through the Thames Valley continuing care review process, rather than our own internal trust complaint procedure."

I cannot agree to Wokingham or Reading PCT suspending their complaints procedures, but I have no objection to you involving Thames Valley Strategic Health Authority. Please advise me who will be performing the function of Appeals Convener within Wokingham PCT.

However, my legal advisers wish to see the full constitution covering the Continuing Care Review Panel. Our challenge is to the legality of the '"eligibility criteria" and if, as we suspect, the panel cannot consider that legality, the procedure is of no interest to us.

It may be better if you invite TVSHA to participate in your complaints procedure under R (Cowl) v Plymouth City Council 14th Dec 2001, when the Court Of Appeal directed that complaints procedures should be adapted to avoid disputes like this going to court. This was included in the protocol of the Administrative Court in March 2002.

As you know, Nick Relph, Chief Executive of Thames Valley Health Authority, has already been copied with correspondence and has already been informed of the web sites above.

Jeremy may also wish to visit these sites for information on Coughlan in general and my mother's case in particular. Out of courtesy I have copied this reply to the Chief Executive of South West Oxfordshire PCT, and will add them to those with "the need to know".
